01 Acceptance of Terms

These Terms of Service ("Terms") form a legally binding agreement between you and ORBITAPPS TECHNOLOGIES LLP ("OrbitApps", "we", "us") governing your access to and use of the Lookzon mobile application, website, and related services (the "Services").

This document is an electronic record under the Information Technology Act, 2000 and does not require any physical or digital signature. By creating an account or using the Services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

02 Eligibility

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to create an account. Users below 18 may use the Services only under the supervision and with the verifiable consent of a parent or lawful guardian, who shall be responsible for the minor's use of the Services.

03 Your Account

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your login credentials and OTPs.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at lookzonsupport@gmail.com of any unauthorised use.

04 License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices you own or control, solely for personal, non-commercial purposes.

You shall not:

• Copy, modify, reverse engineer, decompile, or disassemble the App or any part of it.
• Rent, lease, sublicense, sell, or distribute the App or access to the Services.
• Remove or alter any proprietary notices, trademarks, or labels.
• Use automated systems, bots, or scrapers to access the Services.

05 User Conduct

Lookzon is designed for consensual location sharing among family and trusted contacts. You agree that you will not use the Services to:

• Track, monitor, or stalk any person without their knowledge and explicit consent.
• Harass, threaten, defame, or harm any individual.
• Upload or share content that is unlawful, obscene, or infringes the rights of others, as described under Rule 3(1)(b) of the IT (Intermediary Guidelines) Rules, 2021.
• Impersonate any person or misrepresent your affiliation with any person.
• Transmit viruses, malware, or any code designed to disrupt or damage the Services.
• Violate any applicable law, including the Bharatiya Nyaya Sanhita, 2023 and the IT Act, 2000.

Misuse of the Services for covert surveillance is strictly prohibited. We reserve the right to suspend or terminate accounts and report such conduct to law enforcement authorities.

06 Premium Subscriptions and Payments

Certain features are available only through a paid premium subscription. Subscriptions may be billed through UPI AutoPay, cards, or app store billing, and renew automatically until cancelled. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise. Cancellations and refunds are governed by our Refund & Cancellation Policy.

07 Service Availability and Limitations

The accuracy of location data depends on factors beyond our control, including GPS signal, network connectivity, device settings, battery state, and operating system restrictions. The Services are provided as a supplementary safety tool and are not a substitute for emergency services.

In an emergency, always contact the national emergency number 112 or local authorities directly.

08 Intellectual Property

All rights, title, and interest in the Services, including software, design, logos, the "Lookzon" and "OrbitApps" names, and all related content, are owned by or licensed to ORBITAPPS TECHNOLOGIES LLP and are protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable laws.

09 Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

10 Limitation of Liability

To the maximum extent permitted under applicable law:

• OrbitApps, its partners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill.
• We shall not be liable for any harm, injury, or loss arising from inaccurate, delayed, or unavailable location information, failed notifications, or reliance on the Services in an emergency.
• Our aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount paid by you to us in the three (3) months preceding the event giving rise to the claim, or INR 1,000, whichever is lower.

11 Indemnification

You agree to indemnify and hold harmless OrbitApps and its partners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

12 Suspension and Termination

You may delete your account at any time from the App settings. We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, misuse the Services, or if required by law. Sections relating to intellectual property, disclaimers, limitation of liability, indemnity, and governing law shall survive termination.

13 Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any dispute shall first be attempted to be resolved amicably through good-faith negotiation within thirty (30) days. Failing such resolution, the dispute shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996, seated in Bengaluru, Karnataka, conducted in English. Subject to the foregoing, courts at Bengaluru shall have exclusive jurisdiction.

14 Changes, Contact and Grievance Officer

We may revise these Terms from time to time. Material changes will be notified through the App or by email. For questions or complaints about these Terms, please contact our Grievance Officer, appointed in accordance with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. Grievances will be acknowledged within 24 hours and resolved within 15 days of receipt.
